The Biden administration’s efforts to expand Title IX protections to include LGBTQ+ students have been dealt a significant blow. A recent federal ruling in State of Tennessee v. Cardona by U.S. District Judge Danny Reeves declared the Department of Education’s attempt to extend protections for gender identity and sexual orientation unconstitutional.
Schools must now adhere to the narrower 2020 Title IX regulations, leaving transgender athletes in a precarious position.
On the federal level, the House recently passed the “Protection of Women and Girls in Sports Act,” which seeks to amend Title IX to define sex based solely on reproductive biology and genetics at birth. Proponents argue it addresses fairness and safety, while opponents decry its potential for intrusive enforcement and harassment.
